Terms and Conditions

1. Definitions

- Data Protection Act refers to the Data Protection and Privacy Act, 2019, which regulates the collection and processing of personal data in Uganda (media.ulii.org).

- Consent means any freely given, specific, informed and unambiguous indication of the data subject’s wish by which they, by statement or clear affirmative action, signify agreement to the collection or processing of personal data (ulii.org).

- Electronic Communication means a communication by means of data messages, as defined under the Electronic Transactions Act, 2011 (ulii.org).

2. Consent to Marketing Communications
Subscriber expressly consents to receiving marketing communications from the Provider via email, SMS, telephone calls, instant messaging services, and direct mail. Such consent may be withdrawn at any time in accordance with these Terms (ulii.org, media.ulii.org).

3. Collection and Use of Personal Data
The Provider will collect Subscriber’s personal data (including name, contact details, and communication preferences) and process it solely for sending marketing communications and improving services. All processing will comply with the purpose-limitation and data-minimization principles set out in the Data Protection and Privacy Act (media.ulii.org, ulii.org).

4. Unsolicited Communications and Opt-Out
In compliance with section 26 of the Electronic Transactions Act, 2011, the Provider will not send unsolicited communications without the Subscriber’s prior consent. Subscriber may withdraw consent and opt out at any time by replying “STOP” to SMS, clicking the unsubscribe link in emails, or contacting the Provider directly; the Provider will cease marketing communications within five (5) working days of the opt-out request (ict.go.ug, media.ulii.org).

5. Disclosure to Third Parties
The Provider will not share Subscriber’s personal data with third parties except (a) service providers acting on the Provider’s behalf solely to facilitate marketing communications, or (b) where disclosure is required by law. Any permitted sharing will adhere to the Data Protection and Privacy Act’s requirements (ulii.org, media.ulii.org).

6. Data Retention
Subscriber’s personal data will be retained only as long as necessary to fulfil the purpose of sending marketing communications or until consent is withdrawn, after which the data will be deleted or anonymized in line with the Act’s provisions on erasure and blocking of personal data (media.ulii.org, ulii.org).

7. Compliance with Laws and Standards
These Terms are governed by and construed in accordance with the laws of Uganda, including the Data Protection and Privacy Act, 2019, and the Electronic Transactions Act, 2011. The Provider also adheres to the Advertising Standards issued by the Uganda Communications Commission, ensuring all marketing communications are truthful, not misleading, and socially responsible (media.ulii.org, ucc.co.ug).
